Mianomics Terms of Service
These Terms of Service (“Terms”) govern your purchase of, access to, and use of IB + IVB Pro, including the IB + IVB Pro TradingView indicator, the private Mianomics member portal, pre-market intelligence, personal member journals, related software, scripts, alerts, documentation, educational materials, market commentary, support, and access to the Mianomics member community (collectively, the “Services”).
“Mianomics,” “we,” “us,” and “our” refer to the independent seller operating under the Mianomics name and identified on the purchaser’s Whop receipt. “You” and “your” refer to the purchaser or user of the Services.
By purchasing, accessing, or using the Services, you confirm that you have read, understood, and agreed to these Terms, the Mianomics Financial Risk and Performance Disclaimer, and the Mianomics No-Return and No-Refund Policy.
If you do not agree, do not purchase or use the Services.
1. Seller and Whop’s Role
Mianomics is the supplier and licensor of the Services.
Whop provides marketplace, checkout, payment-processing, and account-access infrastructure. Whop is not the creator, owner, financial adviser, or licensor of the Mianomics indicator or community content.
Your use of Whop is separately governed by Whop’s terms and policies. Questions concerning the Product, license, Discord access, support, cancellation, or refunds should be directed to Mianomics at mianomics@gmail.com.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or use the Services.
By purchasing, you represent that:
- The information you provide is accurate;
- You are authorized to use the selected payment method;
- Purchasing and using the Services is lawful where you live;
- You are not prohibited from accessing the Services under applicable sanctions, export-control, or financial laws; and
- You understand that the Services relate to high-risk financial-market activity.
Mianomics may refuse or terminate access if these requirements are not satisfied.
3. Description of the Services
Depending on the plan displayed at checkout, the Services may include:
- Access to the IB + IVB Pro TradingView indicator;
- Indicator updates and supported configurations;
- Educational materials and market commentary;
- Private access to published pre-market analysis through the Mianomics member portal;
- Access to the Mianomics member community;
- Customer and technical support;
- Trade examples, charts, alerts, or community posts; and
- Other benefits expressly listed on the Whop product page.
Only benefits expressly included in the purchased plan are guaranteed. Previews, roadmap discussions, future-product announcements, or statements about features under development do not create a binding commitment to release those features.
Mianomics may update, improve, replace, or discontinue individual nonessential features. Mianomics will not intentionally remove the core functionality described at purchase during an active prepaid period without providing a reasonable substitute, credit, prorated refund, or other remedy where legally required.
4. Educational Purposes: No Financial Advice
All Services and content are provided solely for general educational and informational purposes.
Nothing provided through TradingView, Whop, Discord, direct messages, livestreams, alerts, charts, screenshots, or other communications constitutes:
- Financial, investment, legal, accounting, or tax advice;
- Personalized investment advice;
- A recommendation suitable for your circumstances;
- An offer or solicitation to buy or sell a financial instrument;
- Portfolio or account management;
- A guarantee of profits or protection from losses; or
- The creation of a fiduciary, adviser-client, or broker-client relationship.
You are solely responsible for conducting your own research and making your own financial decisions. Consult an appropriately licensed professional if you require personalized advice.
5. Trading Risk
Trading securities, futures, options, foreign exchange, cryptocurrencies, commodities, and other financial instruments involves substantial risk. You may lose some or all of your capital. When leverage, margin, short selling, derivatives, or certain digital assets are used, losses may occur rapidly and may exceed the amount initially deposited.
The Mianomics indicator is a technical-analysis tool. It cannot predict the future and may generate delayed, inaccurate, conflicting, false, or losing signals.
No trading indicator, strategy, or system can guarantee profits. Past performance does not guarantee or reliably predict future results.
You are solely responsible for:
- Deciding whether, when, and what to trade;
- Verifying all signals, prices, and settings;
- Selecting position sizes, stop losses, and risk limits;
- Monitoring open positions;
- Understanding the instruments and platforms you use;
- Paying commissions, spreads, slippage, taxes, and other expenses; and
- All profits, losses, liabilities, and consequences arising from your activity.
Never trade with money you cannot afford to lose.
6. Performance Results and Testimonials
Screenshots, winning trades, signal examples, payouts, backtests, testimonials, and other performance-related content may represent selected individual outcomes. They may not show every signal, trade, loss, drawdown, expense, or unsuccessful period.
Results may be actual, simulated, paper-traded, hypothetical, or backtested. Hypothetical results do not represent actual trading and may be prepared with hindsight. They may not fully account for liquidity, slippage, commissions, delayed execution, rejected orders, market impact, emotional pressure, or changing market conditions.
Unless expressly stated, performance claims have not been independently audited. No representation is made that you will achieve results similar to any displayed result. Typical customer results may be unknown, and many users may lose money.
7. Purchases and Payment
Prices, billing intervals, included benefits, trial periods, and applicable taxes are displayed at checkout.
By purchasing, you authorize Whop and its payment partners to charge your selected payment method for the purchase price, applicable taxes, and any disclosed recurring charges.
You are responsible for maintaining accurate billing information. Access may be suspended if a payment is declined, reversed, disputed, or remains unpaid.
Purchases are personal and may not be transferred, resold, assigned, or shared.
8. Subscriptions and Automatic Renewal
If you purchase a recurring subscription, it will automatically renew at the billing interval displayed at checkout until canceled.
You authorize recurring charges to your selected payment method without requiring separate approval before each renewal.
You may cancel future renewal through your Whop member account before the next billing date. Cancellation prevents future renewal but does not reverse a payment that has already been processed.
After cancellation, access ordinarily continues until the end of the paid billing period unless access is terminated because you violated these Terms.
Deleting Discord, leaving the server, uninstalling the indicator, not using the Services, or sending an informal message does not automatically cancel your Whop subscription. You must cancel through Whop or obtain written cancellation confirmation from Mianomics.
You are responsible for canceling before renewal. Except where legally required, refunds or prorated credits are not provided for failure to cancel on time.
9. Personal License
Subject to payment and compliance with these Terms, Mianomics grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to use the Services for your own lawful, noncommercial trading and educational purposes during your active access period.
This is a license, not a sale or transfer of ownership.
Unless expressly authorized in writing, one purchase is limited to:
- One individual;
- One Whop member account;
- One Discord account; and
- One personal TradingView account; and
- One Mianomics portal account activated with the one-time access key issued for that member.
Business, team, resale, educational, signals-service, or multi-user use requires prior written authorization and may require a separate license.
10. Prohibited Use
You may not:
- Share, sell, rent, sublicense, or transfer access;
- Share login credentials, license keys, invite links, files, or protected content;
- Copy, reproduce, republish, upload, or redistribute the indicator or paid materials;
- Reverse engineer, decompile, decode, extract, or attempt to discover source code;
- Remove copyright, trademark, watermark, or ownership notices;
- Record, scrape, archive, mirror, or systematically download paid content;
- Use the Services to create or sell a competing indicator, signals service, course, community, or derivative product;
- Display or distribute signals from the indicator as part of a paid or public service;
- Circumvent licensing, authentication, access, or security controls;
- Exploit bugs, vulnerabilities, or platform errors;
- Use bots or unauthorized automation to access protected content;
- Impersonate Mianomics staff or misrepresent an affiliation with Mianomics;
- Engage in fraud, harassment, threats, spam, doxxing, market manipulation, or illegal conduct; or
- Violate Whop’s, Discord’s, TradingView’s, or another applicable third party’s rules.
Suspected account sharing may result in reasonable identity or account verification and temporary suspension during investigation.
11. Community Rules
Access to the Mianomics member community is a conditional benefit, not an unrestricted right.
Members must interact respectfully and comply with posted community rules. Mianomics may moderate or remove content and restrict members who engage in harassment, discrimination, threats, spam, scams, impersonation, unauthorized promotion, account sharing, chargeback fraud, illegal conduct, or behavior that threatens the community.
Trading opinions posted by members are their own. Mianomics does not verify, adopt, or guarantee member statements.
Never send money, brokerage credentials, wallet credentials, passwords, private keys, or seed phrases to another member. Verify official staff identities before acting on private messages.
12. Intellectual Property
The Services, including software, source code, object code, formulas, calculations, logic, layouts, graphics, branding, videos, written materials, alerts, documentation, and community resources, are owned by or licensed to Mianomics and are protected by applicable intellectual-property laws.
The Mianomics name, related product names, logos, and branding may not be used without prior written permission.
Feedback or suggestions voluntarily provided may be used to improve the Services without compensation, provided Mianomics does not publicly identify you without permission.
13. TradingView and Other Third Parties
The Services may depend on TradingView, Whop, Discord, brokers, exchanges, data providers, internet services, or other third parties.
Mianomics does not control and is not responsible for third-party:
- Outages, errors, delays, or discontinuation;
- Market-data or price discrepancies;
- Account restrictions or terminations;
- Privacy or security practices;
- Trading execution or rejected orders;
- Fees, rules, or policy changes; or
- Losses caused by third-party systems.
You are responsible for maintaining a compatible TradingView account and any required market-data subscription.
Your use of each third-party platform is governed by that platform’s own terms.
Unless expressly stated, Mianomics is not sponsored by, endorsed by, or affiliated with Whop, Discord, TradingView, any broker, exchange, prop firm, or financial institution.
14. Technical Requirements and Support
You are responsible for obtaining compatible hardware, software, internet access, TradingView access, market-data subscriptions, and third-party accounts.
Before purchasing, review the compatibility requirements displayed on the Whop product page. Failure to obtain a clearly disclosed third-party requirement does not create refund eligibility.
Technical problems must be reported to mianomics@gmail.com within seven days of discovery.
Include:
- Your Whop receipt or transaction identification;
- The email used for the purchase;
- Your Whop, Discord, and TradingView usernames;
- The device and platform being used;
- Relevant screenshots or error messages; and
- A clear explanation of the problem and troubleshooting attempted.
Do not send passwords, seed phrases, private keys, or complete payment-card information.
Mianomics will generally provide an initial response within five to seven business days. Mianomics will make commercially reasonable efforts to address reproducible technical problems but cannot guarantee an immediate resolution.
15. Availability and Updates
Mianomics aims to keep the Services available but does not guarantee uninterrupted, permanent, secure, or error-free operation.
Temporary interruptions may occur because of maintenance, software updates, security incidents, third-party failures, legal requirements, or events beyond Mianomics’ reasonable control.
Updates may change settings, calculations, appearance, compatibility, or functionality. You are responsible for reviewing update notices and confirming your configuration before live trading.
16. No-Return and No-Refund Policy
All purchases are governed by the separate Mianomics No-Return and No-Refund Policy incorporated into these Terms.
Because digital access is ordinarily delivered immediately, all sales are final once access is provided, except where:
- Mianomics expressly approves a refund;
- A qualifying duplicate charge or payment-processing error occurs;
- Mianomics fails to provide the purchased access and cannot correct the issue;
- Whop processes a reversal under its applicable terms;
- A refund is required by law, card-network rules, or mandatory consumer rights; or
- Another stated exception in the No-Return and No-Refund Policy applies.
Canceling a subscription prevents future renewal but does not ordinarily create a refund for the current billing period.
17. Suspension and Termination
Mianomics may suspend or terminate access if you:
- Fail to pay;
- Violate these Terms or community rules;
- Share or resell access;
- Infringe intellectual-property rights;
- Engage in fraud, abuse, threats, or unlawful conduct;
- Attempt to compromise the Services; or
- Create material legal, security, or platform risk.
For serious violations, termination may occur without advance notice. To the extent permitted by law, a user terminated for a material violation is not entitled to a refund.
If Mianomics permanently discontinues a prepaid Service for reasons unrelated to your conduct and does not provide a reasonable substitute, Mianomics may provide a prorated refund, account credit, or other legally required remedy.
18. Privacy Notice
Mianomics may receive and process limited information needed to provide the Services, including your name, email address, Whop transaction information, Mianomics and third-party usernames, protected password verifiers and session records, personal-journal content you choose to save, support communications, technical information, and records concerning Product access. Mianomics does not store your readable portal password.
This information may be used to:
- Deliver and administer the Services;
- Verify purchases and licenses;
- Provide customer support;
- Prevent account sharing, fraud, and abuse;
- Maintain security;
- Send necessary Product or account communications;
- Enforce these Terms; and
- Satisfy legal, tax, accounting, or regulatory obligations.
Mianomics does not need or intentionally collect complete payment-card information. Payments are handled by Whop and its payment partners.
Mianomics does not sell personal information. Information may be disclosed to service providers, professional advisers, platforms, or authorities when reasonably necessary to operate the Services, enforce these Terms, prevent fraud, or comply with law.
Records are retained only as reasonably necessary for these purposes. Privacy questions or legally valid access, correction, or deletion requests may be sent to mianomics@gmail.com. Certain records may be retained when required for legal, fraud-prevention, accounting, or dispute-resolution purposes.
Whop, Discord, TradingView, and other third parties separately process information under their own privacy policies.
19. No Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
MIANOMICS DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, PROFITABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, CONTINUOUS ACCESS, AND ERROR-FREE OPERATION.
MIANOMICS DOES NOT WARRANT THAT THE SERVICES WILL GENERATE PROFITS, PREVENT LOSSES, MEET YOUR EXPECTATIONS, OR REMAIN COMPATIBLE WITH EVERY PLATFORM.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
20. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MIANOMICS AND ITS OPERATORS, DEVELOPERS, CONTRACTORS, ADMINISTRATORS, MODERATORS, AND AFFILIATES WILL NOT BE LIABLE FOR:
- Trading or investment losses;
- Lost profits, opportunities, revenue, data, or business;
- Account liquidations or failed evaluations;
- Broker, exchange, prop-firm, TradingView, Whop, Discord, or data-provider actions;
- Indirect, incidental, special, consequential, exemplary, or punitive damages; or
- Losses resulting from reliance on the indicator or community content.
To the fullest extent permitted by law, Mianomics’ total aggregate liability arising from the Services will not exceed the amount you paid for the affected Service during the six months preceding the event giving rise to the claim.
This limitation does not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, or other non-excludable obligations.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mianomics and its operators, developers, contractors, and affiliates from third-party claims, losses, liabilities, and reasonable expenses arising from:
- Your unlawful use of the Services;
- Your material violation of these Terms;
- Your infringement of another person’s rights; or
- Content you post or distribute through the community.
This section does not require you to indemnify anyone for that person’s fraud, gross negligence, or willful misconduct.
22. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Before filing a legal claim, you agree to contact mianomics@gmail.com and provide a written description of the dispute. Both parties will attempt in good faith to resolve the dispute informally for at least 30 days.
Unless mandatory consumer law requires otherwise, the state and federal courts located in New York County, New York, will have exclusive jurisdiction over disputes relating to these Terms.
Nothing in this section eliminates consumer rights or access to a venue that cannot legally be waived.
23. Changes to These Terms
Mianomics may update these Terms to reflect changes to the Services, law, security requirements, or business operations.
Material changes will apply prospectively after reasonable notice where required. Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
The version displayed at the time of purchase governs that purchase unless a later change is required by law or accepted through continued subscription use.
24. General Terms
Entire Agreement: These Terms, the product description displayed at checkout, the Mianomics Financial Risk and Performance Disclaimer, the Privacy Notice, and the No-Return and No-Refund Policy form the agreement between you and Mianomics.
Severability: If one provision is found invalid or unenforceable, the remaining provisions remain effective.
No Waiver: Failure to enforce a provision does not waive the right to enforce it later.
Assignment: You may not transfer your rights under these Terms. Mianomics may assign these Terms as part of a merger, acquisition, reorganization, or sale of the business, subject to applicable law.
Headings: Section headings are for convenience and do not affect interpretation.
